BOOKING TERMS AND CONDITIONS
Booking: You must send us a request through our web site booking form accepting our terms and conditions at the time of confirming your holiday. Your contract is made on the terms of these conditions and on the basis of details shown on your confirmation invoice and is subject to Maldives Travel & Diving law. Under no circumstances does any agent have the authority to alter the terms and conditions of this contract.
2. Payment: You pay 25% of your total invoice upon confirmation and 75% 8 (eight) weeks prior to arrival to the Maldives. The deposit amount may vary according to the supplier and it is a non-refundable deposit, the date the balance payment is due will be stated on your invoice date and may vary from 120 - 60 days prior to departure. If you do not pay your balance, we reserve the right to treat your booking as cancelled, in which case you could be liable to pay us cancellation charges up to 100% of the final invoice total in accordance with our cancellation charges shown in these terms and conditions. There is no contract between us until a written confirmation is sent to you.
3. Cancellation: if you cancel your holiday you must put the cancellation in writing and a cancellation fee will be charged on the scale shown below:-

4. Insurance: Under the terms of this contract you are required to have suitable travel insurance, which must include the costs of medical treatment and repatriation in the event of serious accident or illness and include full search, rescue and hyperbaric treatment if you are taking part in scuba diving or snorkelling activities. We strongly recommend that you take out insurance that includes trip cancellation cover.
5. Changes to original booking: If the customer changes the original booking the company will make every effort to accommodate the customer's requirements. However, if it is not possible, then the cancellation charges will apply. The company will charge an administrative fee of $100 per passenger for changes in booking arrangements. In addition, any amendment fees or cancellation charges charged by the suppliers/airlines/hotels/transport companies will be passed on to the customer.
6. Correspondence: All correspondence concerning any booking will be sent directly to the customer who has requested from our website using the email address. It is the responsibility of the person who request for a booking to make these conditions known to their accompanying party. The submission of our booking form is deemed as acceptance of these terms and conditions.
7. Complaints: If you have a complaint about any element of your holiday you must inform our representative or agent and the supplier (ie. the resort/liveaboard) immediately. Complaints can usually be sorted out whilst you are at the resort. In the event that matters cannot be resolved, details of the complaint should be notified in writing within 14 days of returning from your holiday. We shall not accept any liability in respect of claims that we receive after that date, or which have not been reported to both the local representative/agent of the supplier.
8. Your travel conditions: You accept when you travel with an airline/ground transport/sea transport, that their individual conditions of carriage apply, some of which exclude liability. When travel or health documents are required for your holiday or a visa to enter Maldives, it is your responsibility to obtain these prior to your travel. Please note travel via USA or US Territories (even in transit) requires a US visa and you must have a machine readable passport.
9. Pricing: Our price lists are accurate at time of going to press but the Company reserves the right to increase or reduce the price of any of its holidays before you make your booking. Once you have made your booking and paid your deposit the price will be confirmed in writing.
10. Due to unforeseeable acts of god or force majeure we reserve the right to cancel any holiday, in this event we will return to you all the monies that have been paid or we will offer you an alternative holiday to purchase of a comparable standard.
11. The company does not accept responsibility for any loss, damage or expense which may arise from any event for whatever reason over which the company has no control. The company can only accept responsibility for arrangements which are totally under its control. The company has no control over the supply of services from any supplier and, or their agents servants or employees. The company will make every effort to provide assistance to the customer in the event of any reasonable complaint or claim.
12. Should services supplied to the company increase the overall holiday cost by less than 2% the company will absorb this increase (with the exception of any imposed transport fuel surcharges, local taxes, landing/port fees, etc). Should services supplied to the company increase the overall holiday cost up to 10%, the company will absorb the first 2% and will notify the customer at least 30 days in advance of the departure date and the customer must accept this increase. If the overall increase is more than 10% and the customer decides not to pay the increase, then an alternative holiday may be offered or a full refund provided (excluding insurance premiums). The company guarantees that any increase in the cost of services within 30 days of departure will not be passed on to the customer.
13. Payment for group bookings of 8 people or more is structured as follows: Deposit of 25% for each passenger to secure the booking and interim payments as notified on the confirmation invoice/letter. In general, interim payments are due 6 months prior to departure and balance payments 8-10 weeks prior to departure. Responsibility remains with the group leader who has entered into the contract on behalf of the entire party on the Booking Form. The group leader should collect payments from the group and forward as a batch where possible.
14. The company advises all customers that scuba diving takes place at their own risk and the company cannot accept responsibility or liability in this respect. It is the responsibility of the person who signs the booking form to ensure that all members of their accompanying party who take part in scuba diving are medically fit. All clients will be required to sign a disclaimer form which can be viewed in advance on request. Trip Concept Pvt. Ltd. cannot be held responsible if clients are refused diving on the basis of information provided on the disclaimer or if they arrive at their destination and are considered unfit to take part.
15. It is understood that due to the adventurous nature of land based diving and liveaboard diving holidays, Trip Concept Pvt. Ltd. Cannot compensate for changes in planned diving or vessel itinerary due to adverse weather conditions and equipment breakdowns; vessel breakdowns, seizure or arrest; unavailability of labour due to strikes, lockouts, political or labour disturbances or events outside of our control. Trip Concept Pvt. Ltd. reserves the right to substitute any vessel in order to provide your holiday. Prior to your departure Trip Concept Pvt. Ltd. reserve the right to cancel any charter and refund all monies in the event that a vessel is withdrawn from service and substitute vessel cannot be provided. If, on arrival to your destination, your liveaboard vessel cannot operate within a period of 48 hours then you will be offered an alternative land or liveaboard holiday up to the value of your original holiday booked. No compensation will be paid.
16. The advertised prices and availability of any services or items sold on board the liveaboards/hotels may be subject to change or be withdrawn from service without prior notice.
17. Acting as a booking agent for the resorts/hotels/liveaboards/airlines means that we are sometimes advised by the supplier of a change in your accommodation or holiday arrangements prior to your departure. Unfortunately, hotels/airlines do overbook and rooms are sometimes unexpectedly taken out of service. Although we will do our utmost to ensure this does not affect our clients, if we are advised of any change in your arrangements, which will effect your holiday for more than 48 hours upon arrival, you will have the choice of a full refund or booking an alternative holiday subject to availability.
19. If your resort accommodation arrangements are altered for any period of of your stay we will endeavour to seek compensation on your behalf from the hotel, resort or liveaboard. This type of minor inconvenience can normally be compensated directly by the supplier during your holiday. If you accept the offer of compensation you will not be entitled to any further compensation. The maximum compensation payable by Trip Concept Pvt. Ltd. is $75.00 per person (excluding infants).
